BRIG (JUSTICE) DM SEN ANNUAL MEMORIAL LECTURE
The students of School of Law, Manav Rachna University, Faridabad got an incredible opportunity to attend a one-day lecture on: – “Military Law Challenges in Present Environment & Aligning it with the Current Realities” on 20 January, 2024 at Ashoka Hall, Manekshaw Centre,H4QW+2MQ, Khyber Lines, Delhi Cantonment, New Delhi, Delhi 110010. The students were accompanied by two faculty members: – Dr. SK Bose & Mr. Amit Kumar. The aim of the lecture was to comprehensively explore and discuss the contemporary challenges in military law and its alignment with the evolving realities of the present human resources in the technological landscapes. The session began sharply at 10.00 AM with the honourable dignitaries including Major General Sandeep Kumar, (JAG) Indian Army, Hon’ble Mr. Justice UU Lalit, Former CJI and Dr. Mohammad Asad Malik& Professor, Jamia Milia Islamia University lighting up the lamp. It was followed by a welcome address by Maj. General Sandeep Kumar, JAG (Army) in which he mentioned the inter-play between military law and constitutional law with some references to landmark precedents and its relevance in the present scenario. The Maj. General emphasised on the use of alternative dispute resolution mechanisms as the need of the hour. He also hoped that in the near future, India would have a Uniform Military Code, though there might be some obstacles, but they have to be treated as opportunities in our life. The second session was an enriching experience, Hon’ble Mr. Justice UU Lalit, Former CJI enlightened us on the history and evolution of military law in India. Starting from our first war of independence in 1857 to the Army Act, 1950, he meticulously drafted the military jurisprudence of India. He referred to numerous cases and judgements of which he had been a part of, which changed the dimensions of contemporary military law. The second half of the day, began from 12.00 PM, Mr. R Venkatramani, the learned Attorney-General of India, could not join for the lecture in physical mode, therefore we heard him through an audio- visual clip. He was succeeded by Dr. Mohammad Asad Malik & Professor, Jamia Milia Islamia University, an expert on Constitutional law and criminal laws in India, he highlighted the military justice system in light of the newly proposed criminal laws namely: – Bhartiya Nyaya Sanhita, 2023, replacing the Indian Penal Code (IPC), the Bhartiya Nagarik Suraksha Sanhita which will replace the Criminal Procedure Code (CRPC) and the Bhartiya Sakshya Bill replacing the Indian Evidence Act, 1872 respectively. The day concluded with working lunch and students feeling exhilarated and brimming with confidence and utmost respect for our armed forces.
